Acceptable Use Policy
What you may and may not do with StarSmith — likeness authorization, prohibited content, moderation, reporting, and enforcement.
1. Introduction and Scope
This Acceptable Use Policy (this "Policy") governs your use of StarSmith and related services (the "Service"). It forms part of and is incorporated into our Terms of Service, and applies together with our Terms of Service and Privacy Policy.
StarSmith is an AI content creation and operations assistant for creators. This Policy applies to:
- the images you upload — your own selfies and reference material;
- the prompts and briefs you write;
- the images and captions generated through the Service;
- your interactions with Smith Agent, on the web and through Telegram;
- your account conduct on the Service.
By accessing or using the Service, you agree to comply with this Policy. Violations may result in content removal, feature restrictions, suspension or termination of your account, and referral to law enforcement where warranted.
2. Core Principles
The Service is built on three principles:
2.1 Authorization — Image generation may only use your own likeness, or material for which you have explicit authorization from the rights holder. This is a precondition of using the Service, not an option.
2.2 Lawful and non-explicit — The Service is for lawful, non-pornographic, non-NSFW creator content only. We neither provide nor permit adult content creation.
2.3 Transparency — Images produced through the Service are AI-generated content. When you publish them, you must follow the rules of the platform you publish on, including disclosing AI generation where required.
3. General Requirements
You agree to:
- comply with all applicable laws and regulations, including those governing intellectual property, likeness and publicity rights, privacy, and data protection;
- before uploading any image showing an identifiable person, ensure that you are the rights holder of that likeness or have obtained explicit authorization;
- use the Service responsibly, considering the impact on the people depicted and on the public;
- report violating content or conduct when you become aware of it;
- cooperate with our investigations into potential misuse;
- keep your account information accurate and ensure only you access your account.
4. Absolutely Prohibited — Zero Tolerance
The following result in immediate termination of your account with no refund of fees paid, and we reserve the right to report them to the competent authorities:
4.1 Involving minors
- uploading the likeness of any minor;
- generating any sexual, suggestive, violent, or otherwise harmful content involving minors;
- any content that could be used to exploit, groom, or harm a minor.
4.2 Using another person's identity without authorization
- uploading another person's likeness for generation, whether that person is a celebrity, public figure, political figure, private individual, or deceased;
- impersonating another person or fabricating someone's identity;
- producing depictions of another person likely to be mistaken for authentic imagery.
4.3 Sexual and intimate content
- any pornographic, sexually explicit, nude, partially nude, or sexually suggestive content — this applies even when the likeness is your own;
- any non-consensual intimate content depicting a real person.
4.4 Content used to harm others
- content used for harassment, bullying, blackmail, extortion, or revenge;
- content intended to damage someone's reputation without factual basis;
- fraudulent representations of identity for financial gain.
4.5 Seriously unlawful content
- content promoting or facilitating terrorism, violent extremism, or mass violence;
- content inciting genocide or group hatred.
5. Prohibited Content Categories
You may not upload, submit, or generate content that:
5.1 Violates rights
- infringes copyright, trademark, or other intellectual property rights;
- violates another person's likeness, privacy, or publicity rights;
- uses copyrighted images, material, or brand elements without authorization.
5.2 Causes harm
- promotes violence, terrorism, or dangerous activity;
- constitutes hate speech or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics;
- contains graphic violence or gore, or promotes self-harm;
- provides instructions for illegal activity.
5.3 Misleads or deceives
- constitutes misinformation about health, science, current events, or public safety;
- facilitates scams, fraud, phishing, or false advertising;
- presents AI-generated content as authentic photography in order to mislead others;
- impersonates a real brand, institution, or organization.
5.4 Political content
- political disinformation or content used for election manipulation;
- synthetic depictions of political figures.
6. Likeness and Authorization Requirements
6.1 Your own likeness only
Image generation requires you to upload a selfie of yourself. By uploading, you represent and warrant that:
- you are the rights holder of that likeness, or you have obtained the rights holder's explicit and sufficient authorization;
- you have the right to use that material for AI generation through the Service;
- the material does not depict any minor.
6.2 Reference material
Inspiration library material in the Service comes from third-party stock libraries and is provided as reference for style, composition, setting, and wardrobe only. Such material:
- may not be used as a source of any person's identity;
- may not be redistributed by you directly;
- remains subject to the respective library's license terms.
Reference material you upload yourself must likewise be material you own or are authorized to use.
6.3 Celebrities and public figures
The Service does not permit use of the likeness of celebrities, public figures, or any third party — regardless of any claimed authorization, and regardless of whether the intent is parody, satire, or commentary. This differs from some other platforms: our product exists to help creators create content of themselves, so we do not provide a parody exception.
6.4 We may require verification
Where there is reasonable doubt, we may ask you to provide:
- identity verification confirming that the uploaded likeness is your own;
- authorization documentation, where authorized material is involved;
- age verification.
If you decline to cooperate with verification, we may restrict the relevant features. Verification material you submit is handled securely in accordance with our Privacy Policy.
7. Technical and Account Abuse
You may not:
- attempt to circumvent credit metering, usage limits, content rules, or any safety mechanism, including through prompt injection or "jailbreak" techniques;
- abuse the Service through automated scripts, scraping, or bulk requests, or place abnormal load on our servers;
- reverse engineer or decompile the Service, or attempt to extract the underlying models, prompts, or system implementation;
- access another user's account, data, or content without authorization;
- create multiple accounts to claim new-user credits more than once or to circumvent usage limits;
- resell or sublicense the Service, or offer it as the backend capability of your own product;
- do any of the above through the Telegram channel, or otherwise violate Telegram's own terms of service.
8. Disclosure of AI-Generated Content
8.1 Images produced through the Service are AI-generated content.
8.2 When you publish them, you must:
- follow the rules of the publishing platform regarding AI-generated content, including applying labels where the platform requires them;
- not represent generated content as authentic photography untouched by AI;
- comply with advertising regulations and disclosure requirements applicable to commercial promotion.
8.3 We do not warrant that generated content will pass any third-party platform's review. You are responsible for how you use generated content and for the consequences of that use.
9. Content Moderation
9.1 How we moderate
We apply layered moderation to content risk:
- Pre-generation prompt review — the prompts you submit are screened for safety, and generation requests that violate this Policy are blocked;
- Post-generation image review before display — generated results are assessed for content safety before being shown to you, and results that fail are not displayed;
- Upload validation — uploaded images are checked for format, quality, and safety;
- Actively maintained blocking rules — we update our blocking rules on an ongoing basis to address emerging abuse techniques;
- Human review — content flagged by automated systems, and content reported by users, is reviewed by our personnel;
- Moderation and enforcement logs — we record moderation determinations and enforcement actions for review, appeals handling, and compliance purposes;
- Anti-automation measures — including human verification and monitoring for anomalous usage patterns.
9.2 Ongoing improvement
Content safety capabilities have to evolve alongside technology and abuse techniques. We continuously evaluate the accuracy of our moderation systems, update our blocking rules and moderation models, expand our human review capacity, and update this Policy when our mechanisms change materially.
9.3 Our discretion
We have no obligation to pre-screen all content, but we reserve the right to review and to act. For content or accounts that breach this Policy or create legal, safety, or abuse risk, we may refuse to process, remove content, restrict features, suspend, or terminate the account.
10. Reporting
10.1 When to report
Please report to us if you become aware of:
- content or conduct that violates this Policy;
- serious violations involving the safety of minors;
- use of your likeness by someone else without your consent;
- content infringing your intellectual property or other lawful rights.
10.2 How to report
Email support@starsmith.ai and include, where possible:
- the content or account involved;
- what the violation is, with any supporting evidence;
- the sections of this Policy you believe were violated;
- your contact details so we can follow up.
10.3 How we handle reports
- Confidentiality — we keep the reporter's identity confidential, except where disclosure is legally required;
- Objectivity — reports are reviewed independently and objectively;
- Anti-abuse — malicious or false reports are recorded and may lead to enforcement against the reporting account.
11. Enforcement
We take one or more of the following actions based on the nature and severity of the violation, whether it is repeated, and whether it appears deliberate:

Fees already paid are not refundable where an account is terminated for a violation.
12. Appeals
If you believe an enforcement action was made in error, you may appeal within 30 days of being notified by emailing support@starsmith.ai and setting out:
- why you believe the action was in error;
- any additional context or evidence;
- any corrective steps you have taken.
One appeal is permitted per enforcement decision. We will complete our review and inform you of the outcome within a reasonable period.
13. Shared Responsibility
13.1 Your responsibilities — You are responsible for all content uploaded, submitted, and generated through your account, including holding the necessary likeness authorization, complying with this Policy, and how you use generated content and the consequences of that use.
13.2 Our responsibilities — We commit to stating our content rules clearly, receiving and reviewing reports, enforcing this Policy consistently, investing continuously in our content safety capabilities, and updating this Policy when our capabilities or rules change.
14. Changes to This Policy
We may update this Policy to address new technologies, regulatory changes, or emerging abuse techniques. The updated version will be posted on this page with a revised last-updated date. For material changes we will give additional notice, such as an in-product message or an email. Continuing to use the Service after changes take effect means you accept the updated Policy.
15. Definitions
- Authorization / consent — a freely given, informed, and explicit permission from the rights holder.
- Likeness — any recognizable representation of an individual, including their face and other identifying features.
- Minor — any person under the age of 18.
- Deepfake — AI-generated or manipulated media that realistically depicts a real person in a situation that did not occur.
- Non-consensual — created or distributed without the explicit permission of the person depicted.
- NSFW — content not suitable for public or workplace display; in this Policy it refers primarily to sexual and explicit content.
- AI-generated content — any content generated by, or significantly modified by, the AI models used in the Service.
